Terms of Service

These Terms govern your access to and use of the Bend Pays AR collections platform (“Service”) operated by Bend Pays, Inc. (“Bend,” “we”). By signing up for or using the Service, you agree to these Terms.
1. The Service
Bend provides software that helps businesses manage their accounts receivable, send invoices, run collection cadences, accept payments, handle disputes, and report on portfolio performance. Bend is a system of engagement; your accounting system remains the system of record. Bend is not your debt collector and does not act as a debt collector under FDCPA.
2. Your account
You are responsible for all activity under your tenant workspace. Keep credentials secure. Notify us within 24 hours of any suspected unauthorized access at security@bendpays.com. Bend offers impersonation strictly for support purposes; every impersonation event is logged and visible in your audit log.
3. Acceptable use
- No sending communications to consumers without a legitimate business relationship.
- No use of Bend to collect debts you don’t legally own or weren’t assigned.
- No bypassing the communications policy engine. Bend honors per-channel consent (email, SMS, voice, postal mail) and opt-out independently for each. Once a consumer opts out of a channel via the consent ledger, all commercial sends on that channel are suppressed regardless of cadence configuration. Tenants may not attempt to route around this gate. Transactional messages (sign-in links, PIN codes, payment receipts) are sent in response to direct user actions and are not subject to the opt-out gate. - No reverse engineering, except as permitted by law.
4. Fees
Subscription fees are billed monthly via Stripe per the plan you selected. Past-due accounts (60+ days) may be write-blocked and eventually canceled. Bend may pass through Stripe processing fees on payments collected on your behalf via Stripe Connect; those fees are separate from your Bend subscription.
5. Data ownership
Your data is yours. You can export it at any time via the Reporting → Exports flow. We do not claim ownership of your invoices, payments, or customer records. We do retain the right to use aggregated, de-identified usage data to improve the Service.
6. Service availability
We target high availability but do not guarantee uninterrupted service. Scheduled maintenance is communicated in advance via the public status page. We are not liable for losses caused by outages of subprocessors (Stripe, Resend, Neon, Vercel, accounting providers).
7. Termination
You can cancel at any time from /settings/billing. Service continues through the end of your current billing period. After cancellation, we retain your data for 90 days for export, then permanently delete per the retention schedule in our Privacy Policy.
8. Disclaimers and liability
THE SERVICE IS PROVIDED “AS IS.” To the maximum extent permitted by law, Bend disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. Aggregate liability is limited to the amounts you paid Bend in the 12 months preceding the claim.
9. Changes
We may update these Terms with at least 30 days’ notice for material changes, communicated by email to tenant admins. Continued use after the effective date constitutes acceptance.
10. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
